# When to Consider Civil Litigation for Your Case

Not every dispute needs a lawsuit — but some do. Here is how to know when civil litigation makes sense, and what to expect if you move forward.

When someone else’s actions cost you money, health, or peace of mind, it is natural to wonder whether you should take legal action. Litigation is a serious step, and it is not always the right one. But in many situations, it is the most effective way to be made whole. Here is how to think it through.

## Situations Where Litigation Is Worth Considering

Civil litigation may make sense when:

- You were injured because of someone else’s negligence — a car crash, a fall on unsafe property, a dog bite, or a defective product.
- You were harmed by medical negligence that fell below the accepted standard of care.
- A contract was broken and the other side won’t make it right.
- Informal efforts have failed — calls, letters, and negotiation haven’t produced a fair result.
- The amount at stake is significant relative to the time and cost of pursuing it.

## Try to Resolve It First — But Don’t Wait Too Long

Many disputes resolve without a lawsuit through a demand letter, negotiation, or mediation. These options can be faster and less costly. However, waiting has real risks:

### Deadlines Are Strict

Virginia sets statutes of limitations for civil claims. Personal injury claims, for example, generally must be filed within two years, and contract claims have their own deadlines. Missing a deadline can end your case before it starts, so it is wise to speak with an attorney early, even while you explore settlement.

### Evidence Fades

Photos, video footage, records, and witness memories are easiest to preserve soon after an incident.

## A Virginia Rule Worth Knowing: Contributory Negligence

Virginia is one of the few places that follows contributory negligence. In many negligence cases, if the injured person is found even slightly at fault, they may be barred from recovering. This makes careful case evaluation — and how the facts are presented — especially important.

## What the Litigation Process Looks Like

1. Case evaluation — reviewing facts, documents, and potential damages.
2. Filing the complaint — formally starting the case in the appropriate court.
3. Discovery — both sides exchange information, documents, and testimony.
4. Negotiation and mediation — many cases settle at this stage.
5. Trial — if no fair agreement is reached, a judge or jury decides.

## Questions to Ask Before Moving Forward

- What outcome do I want — compensation, a corrected record, an enforced agreement?
- What evidence do I have, and what can still be gathered?
- What are the realistic costs, timeline, and risks?
- Is there a deadline approaching?
